Please read these Terms and Conditions (“Terms”) carefully before using cherryontopcheesecakes.ca (the “Site”) or placing an order with Cherry on Top Cheesecakes (“we,” “our,” or “us”). By accessing our Site or placing an order, you agree to be bound by these Terms and all applicable Canadian federal and provincial laws. If you do not agree, please do not use our Site or services.
1. About Us
Cherry on Top Cheesecakes is a Canadian bakery business operating through cherryontopcheesecakes.ca. We specialize in custom and pre-designed cheesecakes available for order and pickup.
2. Eligibility
By using our Site and placing an order, you represent that you are at least 18 years of age or are placing an order under the supervision of a parent or legal guardian. We reserve the right to refuse service to anyone at our sole discretion.
3. Orders & Custom Cakes
All orders are subject to availability and our acceptance. We reserve the right to decline or cancel any order for any reason, including but not limited to product unavailability or errors in pricing.
Custom Cake Orders:
• Custom orders are accepted on a request basis — please contact us to discuss availability and lead time for your specific order
• Order details, design specifications, and any dietary requirements must be confirmed in writing at the time of booking
4. Pricing & Payment
All prices are listed in Canadian dollars (CAD) and are subject to applicable taxes (HST). Prices are subject to change without notice, but changes will not affect confirmed orders.
Payment is required in full at the time of order, unless a deposit arrangement has been agreed upon for custom orders. We accept payment via Visa, Mastercard, and e-transfer. All transactions are processed securely.
5. Pickup
Pickup: Orders available for pickup must be collected at the agreed time and location.
Once an order has been picked up or delivered and accepted, responsibility for the product transfers to the customer. We recommend transporting cheesecakes in a flat, cool vehicle and refrigerating promptly upon arrival.
6. Allergens & Dietary Information
Our products are made in a kitchen that handles common allergens including but not limited to dairy, eggs, gluten, nuts, and soy. While we take care to accommodate dietary requests, we cannot guarantee that any product is completely free from allergens due to shared equipment and kitchen environment.
It is the customer’s responsibility to inform us of any allergies or dietary restrictions at the time of ordering. Cherry on Top Cheesecakes is not liable for any allergic reactions or adverse health effects arising from consumption of our products.
7. order Concerns
If you have any concerns about your order, please contact us as soon as possible at cherryontopcheesecakes@gmail.com and we will do our best to make it right. We do not offer refunds for products that have been consumed, partially consumed, or where the concern is a matter of personal taste preference.
8. Intellectual Property
All content on this Site, including but not limited to text, photographs, logos, graphics, and design elements, is the property of Cherry on Top Cheesecakes and is protected by Canadian copyright law. You may not reproduce, distribute, or use any content from this Site without our prior written permission.
9. Limitation of Liability
To the fullest extent permitted by applicable Canadian law, Cherry on Top Cheesecakes shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Site or our products, including damages for loss of profits, goodwill, or data.
Our total liability for any claim arising from an order shall not exceed the amount paid by you for the order in question.
10. Disclaimer of Warranties
Our Site and its content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ontario.

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with a revised “Last Updated” date. Your continued use of the Site or placement of an order after any changes constitutes your acceptance of the updated Terms.
